These Terms & Conditions (“Terms”) govern your use of the Team Spirit platform (“Service”) operated by Conclave HQ (“we”, “us”, “our”). By creating an account or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.
1. About the Service
Team Spirit is a sports team management platform that allows clubs to manage teams, players, attendance, events, and coaching observations. It is intended for use by club owners, coaches, assistant coaches, and parents.
2. Eligibility
- You must be at least 18 years old to create an account.
- If you are registering on behalf of a sports club, you confirm that you have the authority to bind that club to these Terms.
- You are responsible for ensuring that any individuals you invite to the platform (coaches, parents) are made aware of these Terms.
3. Account responsibilities
- You are responsible for maintaining the confidentiality of your login credentials.
- You must notify us immediately at support@conclavehq.com if you believe your account has been compromised.
- You are responsible for all activity that occurs under your account.
- You must not share your account with others or allow unauthorised access.
4. Acceptable use
You agree to use the Service only for lawful purposes and in a manner that does not infringe the rights of others. You must not:
- Post or transmit content that is unlawful, offensive, defamatory, or discriminatory.
- Harass, bully, intimidate, or threaten any other user, player, parent, or member of staff.
- Upload or share content that sexualises minors or violates safeguarding principles.
- Use the platform to collect or share personal data in violation of applicable data protection laws.
- Attempt to gain unauthorised access to any part of the Service or its infrastructure.
- Use the Service to send spam, unsolicited communications, or malicious content.
- Reverse engineer, decompile, or attempt to extract the source code of the Service.
- Impersonate any person or entity or misrepresent your affiliation.
5. Anti-bullying and safeguarding policy
Team Spirit is used by sports clubs that often involve children and young people. We take the safety and wellbeing of all users — especially minors — extremely seriously.
You must not use the Service to:
- Bully, harass, or intimidate any player, parent, coach, or other user.
- Make derogatory comments about a player's ability, appearance, background, or identity.
- Share observations or notes that are humiliating, discriminatory, or designed to cause distress.
- Target individuals on the basis of age, disability, gender, race, religion, sexual orientation, or any other protected characteristic.
- Publish content about a minor without appropriate parental or guardian consent.
Club owners and coaches are responsible for maintaining a safe and respectful environment within their club on this platform. This includes:
- Only inviting trusted individuals to access player data.
- Ensuring observations and notes are constructive, professional, and appropriate.
- Removing access from any individual who misuses the platform.
We reserve the right to suspend or terminate accounts that we believe, in our reasonable judgement, are being used in a manner that puts minors or other users at risk.
6. Player data and safeguarding
Club owners and coaches who create or manage player profiles are acting as data controllers for that data. You confirm that:
- You have appropriate consent or a legitimate basis for entering player data, including data relating to minors.
- You have informed parents or guardians that player data (including observations) is being recorded on a digital platform.
- You will comply with all applicable data protection laws, including UK GDPR and the Data Protection Act 2018.
7. Intellectual property
The Team Spirit platform, including its design, code, branding, and documentation, is owned by Conclave HQ and protected by intellectual property laws. You may not copy, reproduce, or distribute any part of the Service without our prior written consent. Content you enter into the platform (player data, observations, notes) remains yours; you grant us a limited licence to store and display it solely to provide the Service to you.
8. Service availability
We aim to provide a reliable service but do not guarantee uninterrupted availability. We may suspend, modify, or discontinue the Service (or any part of it) at any time, with reasonable notice where possible. We are not liable for any loss arising from downtime or service interruptions.
9. Limitation of liability
To the fullest extent permitted by law, Conclave HQ shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of (or inability to use) the Service, including loss of data, revenue, or business opportunity.
Our total liability for any claim arising from these Terms or the Service shall not exceed the amount you paid us (if any) in the 12 months preceding the claim.
10. Termination
You may stop using the Service and request deletion of your account at any time by emailing support@conclavehq.com.
We reserve the right to suspend or terminate your access to the Service at any time if you breach these Terms, with or without notice depending on the severity of the breach.
11. Changes to these Terms
We may update these Terms from time to time. We will notify account holders of material changes by email. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
12. Governing law
These Terms are governed by the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
